Please review these Terms of Service carefully. They constitute a legally binding agreement between you and Shield Forensics International Limited, operating from its main office, and governing our engagements.
1. Agreement to Terms
By accessing or using the Shield Forensics International website (the "Site"), or by engaging any of the forensic investigation, consultation, or related services (collectively, "Services") offered by Shield Forensics International Limited ("we," "our," or "us"), you ("Client," "User," "you") agree to be bound by these Terms of Service ("Terms"). These Terms govern your access to and use of our Site and Services, primarily from our main office. If you do not agree to these Terms in their entirety, you must not use our Site or Services. For specific client engagements, these Terms may be supplemented or superseded by a formal written Service Agreement.
2. Description of Services
Shield Forensics International provides specialized forensic investigation and consultation services from our base, including but not limited to digital forensics, data recovery, forensic document examination, fingerprint analysis, and expert witness testimony, as more fully described on our Site and detailed in specific client engagement proposals or Service Agreements. All Services are rendered with professional diligence, in accordance with applicable industry best practices, ethical standards, and relevant local legal frameworks. The scope, deliverables, and fees for any specific engagement will be outlined in a formal proposal or Service Agreement.
3. Use of Our Site and Intellectual Property
You are granted a limited, non-exclusive, non-transferable license to access and use our Site for lawful informational and engagement purposes only. You agree not to:
- Use the Site in any way that violates any applicable local law or international regulation.
- Engage in any conduct that restricts or inhibits anyone's use or enjoyment of the Site.
- Use the Site in any manner that could disable, overburden, damage, or impair the Site.
- Attempt to gain unauthorized access to any parts of the Site or its connected systems.
The Site and its entire contents are owned by Shield Forensics International Limited or its licensors and are protected by local and international copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or modify any material on our Site without prior written consent.
4. Confidentiality and Data Handling
Shield Forensics International is committed to maintaining the strict confidentiality of all client information and case-related data. Our practices regarding the collection, use, and protection of personal information are detailed in our Privacy Policy, which is incorporated by reference into these Terms and addresses compliance with relevant Data Protection Acts (DPA). For specific engagements, confidentiality obligations will be further defined in a Non-Disclosure Agreement (NDA) or the client Service Agreement provided from our main office.
5. Disclaimer of Warranties
Our Site and Services are provided on an "as is" and "as available" basis. While Shield Forensics International strives for accuracy and application of accepted forensic methodologies from our main facility, we do not warrant that the results obtained from our Services will be error-free or guarantee a particular outcome in any legal or investigative matter. Our liability is limited as defined in client Service Agreements.
6. Limitation of Liability
To the fullest extent permitted by local law, Shield Forensics International Limited shall not be liable for any damages arising out of or in connection with your use of the Site or our Services, except as explicitly stated in a client Service Agreement. This includes any direct, indirect, special, incidental, consequential, or punitive damages.
7. Governing Law and Dispute Resolution
These Terms and any dispute arising out of or related to them, the Site, or our Services shall be governed by and construed in accordance with the laws of the Republic of Kenya, without regard to its conflict of law principles. Any legal suit, action, or proceeding shall be instituted exclusively in the competent courts located in Kenya (Commercial High Court, Nairobi). You waive any objections to such jurisdiction and venue. Alternative dispute resolution mechanisms, such as arbitration at a recognized international arbitration centre, may be specified in individual Service Agreements issued from our main office.
8. Changes to Terms of Service
We reserve the right to revise, modify, and update these Terms from time to time. All changes are effective immediately when posted on the Site. Your continued use of the Site or Services following such changes means you accept and agree to them.
9. Entire Agreement
These Terms, our Privacy Policy, and any applicable client Service Agreement or NDA constitute the sole and entire agreement between you and Shield Forensics International Limited regarding the Site and Services provided from our main office.
